  • Labrador Technologies Inc. ("Labrador") is committed to protecting information that can be used to personally identify you ("Personal Information"). The purpose of this Privacy Policy is to inform you about how Labrador collects, uses and safeguards your Personal Information in association with our wellTrieverTM data retrieval software and any services we provide using or in association with that software (collectively, these software and services are “Software”), and to provide you with contact information should you have any questions or concerns about Labrador's privacy practices.
  • By using the Software, you are consenting to the data practices described in this Privacy Policy. We may update this Privacy Policy from time to time. Any updates to this Privacy Policy will be published on this webpage and will be effective as of the date they are published. Your use of the Software on or after the date an updated Privacy Policy is published constitutes your consent to that updated Privacy Policy.
  • What information does Labrador collect?
    Labrador does not automatically gather any Personal Information from you. Labrador obtains your Personal Information only if you supply it voluntarily by completing an online form when you are creating an account to use the Software. To create an account, you must supply Personal Information such as your name, company name, and e-mail address. If you want to purchase reports containing well data, you must also provide your valid credit card information (“Credit Card Information”) at the time of purchase of the report, which is securely collected and stored by Stripe Payments Canada, Ltd. ( “Stripe”), a third party credit card processing company, whose website is www.stripe.com/ca.
  • How does Labrador use your personal information?
    Labrador may use your Personal Information as reasonably required to operate, maintain, and update the Software, such as for the following:

    1. To create an account with which you may login and use the Software;

    2. To sell you and charge you for reports comprising well data;

    3. To alert you to and to provide you with Software updates;

    4. To save customized Software settings for you;

    5. To collect statistical information about Software usage to create Software updates;

    6. To send marketing materials to customers;

    7. To send surveys to customers;

    8. To respond to questions, comments, or feedback you may have about the Software;

    9. To enable our contractors such as website hosting companies (“Contractors”) to help us operate and maintain the Software. This may require us to send Personal Information to the Contractors. Any Contractor to whom we send your Personal Information will have executed a confidentiality agreement with us that requires that Contractor to keep your Personal Information confidential.

  • Disclosure of Your Personal Information
    Except to Contractors as described in the preceding section, or as described in this section of this Privacy Policy, Labrador does not sell, trade, or otherwise transfer to any third parties your Personal Information.

    In addition, Labrador may also disclose your Personal Information as permitted or required by law. For example, Labrador may disclose Personal Information to those governmental bodies who have authority to obtain it and who request it from us, in order to comply with a warrant or subpoena issued by a court of competent jurisdiction, or to comply with document production requirements.

    In the event of a sale or contemplated sale of all or substantially all of the assets of Labrador, Labrador may transfer Personal Information in its control to a third party purchaser or potential purchaser agreeing to use and protect Personal Information in the same manner identified in this Privacy Policy.

    We may have to send some of your Personal Information to the United States for processing. For example, Stripe provides some of all of its credit card processing services from the United States. Consequently, your Credit Card Information may be transferred, processed, and stored in the United States, may be subject to disclosure by Stripe in accordance with applicable law, and may be subject to Stripe’s privacy policy, which can be found here: www.stripe.com/ca/privacy.
  • Does Labrador use cookies?
    Yes. Cookies are bits of electronic information that are sent to your computer while you are viewing a website. Cookies work in combination with the content within the website to capture and remember information. For instance, cookies are used to track your activity and understand your preferences based on previous or current website activity. This enables Labrador to provide you with services or to improve your web browsing experience. Labrador also uses cookies to provide it with aggregate data about site traffic and site interaction so that Labrador can offer better site experiences and tools in the future.
  • Your consent
    By choosing to provide Labrador with your Personal Information you are consenting to its use in accordance with the principles outlined in this Privacy Policy. If you do not agree with how we plan to use and protect your Personal Information as described in this Privacy Policy, then do not provide your Personal Information to Labrador. Unfortunately, certain services can only be offered if you provide your Personal Information to Labrador. Therefore, if you choose not to provide Labrador with Personal Information, Labrador may not be able to offer you those services.
  • How is Your Personal Information Stored?
    Labrador uses standard industry practices to safeguard the confidentiality of your Personal Information. Labrador treats data as an asset that must be protected against loss and unauthorized access. You should be aware, however, that the transmission of data or information over the Internet or other publicly accessible networks is inherently insecure, and is susceptible to possible loss, interception or alteration while in transit. Labrador does not assume any liability for any damage you may experience or costs you may incur as a result of any transmissions over the Internet or other publicly accessible networks, such as transmissions involving exchanging e-mail with us. While Labrador will take commercially reasonable efforts to safeguard the privacy of your Personal Information and to treat that Personal Information in accordance with this Privacy Policy, in no event will that Personal Information you provide to Labrador be deemed to be confidential, create any fiduciary obligations to you on the part of Labrador, or result in any liability to you on the part of Labrador in the event that that Personal Information is inadvertently released by Labrador or accessed by third parties without Labrador’s consent.
  • Retention of Your Personal Information
    Labrador will retain your Personal Information for as long as it is reasonably required to operate, maintain, and update the Software and in order to satisfy various accounting and legal requirements. Labrador will take steps to ensure that your Personal Information is destroyed or removed when it no longer requires your Personal Information.
  • How Do You Opt-out, Remove or Modify Information You Have Provided to Labrador?
    You can access and review your Personal Information held by Labrador and make corrections to it by contacting Labrador's Privacy Officer directly via email, or by writing the Privacy Officer, c/o Labrador Technologies, 350 229 11th Avenue SW, Calgary, Alberta, T2G 0Y1, CANADA. Labrador will use commercially reasonable efforts to provide the information you require within a reasonable time and no later than 30 days following the request.
